APALY HEALTH INC.

Section 1: Parties Covered by This Consent

By accepting the Apaly Health Inc. Terms of Use, you provide your express written consent to receive communications from all of the following:

• Apaly Health Inc., a Delaware corporation operating the ApalyRx prescription benefit platform
• ApalyRx LLC, a Texas Class G centralized prescription processing pharmacy (NPI 1912873969) and wholly owned subsidiary of Apaly Health Inc.
• Dispensing Pharmacy partners designated to fulfill your prescriptions under the program
• Program Suppliers whose products are covered under your health plan's program, and their affiliated companies, agents, and authorized service providers
• Third-party service providers acting on behalf of any of the foregoing in connection with the operation of the ApalyRx program

For purposes of this Consent, "Program Supplier" means any manufacturer, pharmacy, distributor, or other entity that supplies products or provides pricing to eligible members through the ApalyRx program.

This Consent covers communications from all parties listed above regardless of whether such communications are made under the Apaly Health Inc. brand, the ApalyRx brand, a Dispensing Pharmacy brand, or a Program Supplier brand, provided the communications relate to the ApalyRx program or your covered medications.

Section 2: Types of Communications Covered

2.1 Methods of Communication. This Consent covers the following types of communications to the telephone number or numbers you provide at enrollment or that you update through your account:

• Telephone calls, including calls made using an automated telephone dialing system or an artificial or prerecorded voice
• Text messages (SMS and MMS), including messages sent using automated messaging systems
• Prerecorded voice messages delivered to voicemail
• Push notifications through the ApalyRx mobile application, if applicable

2.2 Transactional Communications. You consent to receive transactional communications related to your use of the ApalyRx program, including:

• Prescription routing notifications and pharmacy selection prompts
• Cost share amount disclosure and payment confirmation requests
• Prescription status updates, including processing, verification, and fulfillment status
• Shipping and delivery notifications
• Eligibility verification and enrollment confirmations
• Benefit change notifications affecting your active prescriptions
• Refill prompts and prescription expiration notices
• Billing and payment notifications, including payment failures and receipts
• Program change notifications affecting your coverage or pharmacy options
• Regulatory and compliance communications required by applicable law

2.3 Marketing and Promotional Communications. You also consent to receive marketing and promotional communications related to the ApalyRx program and your covered medications, including:

• Information about program benefits, pricing, and available fulfillment options
• Medication adherence reminders and clinical support program information
• Patient support program information from Program Suppliers, including copayment assistance programs, nurse educator services, and adherence programs
• New program features, covered medications, and participating pharmacy options
• Health and wellness information related to your covered medications

2.4 Message Frequency. Message frequency will vary based on your prescription activity and program participation. Transactional messages will be sent as needed in connection with your active prescriptions. Marketing and promotional messages will not exceed four messages per calendar month from Apaly Health, though Program Suppliers and Dispensing Pharmacy partners may send additional communications within the scope of their own programs and this Consent.

Section 3: Your Telephone Number and Authorization

3.1 Number Provided. This Consent applies to the telephone number or numbers you provide to Apaly Health at enrollment, and to any telephone number or numbers you subsequently provide or update through your account at apalyrx.net. By providing a telephone number, you represent and warrant that the number is a valid mobile or telephone number of which you are the owner or authorized user.

3.2 Number Changes. You agree to promptly notify Apaly Health if you stop using a particular telephone number or if that number is reassigned to another person. You may update your telephone number at any time through your account at apalyrx.net or by contacting Apaly Health at privacy@apalyrx.com.

3.3 Do Not Call Registry. By providing your telephone number and accepting this Consent, you agree to receive calls and messages even if your telephone number is registered on any state or federal Do Not Call list. This Consent supersedes any prior Do Not Call registration with respect to communications from the parties identified in Section 1 in connection with the ApalyRx program.

3.4 Recorded Calls. Telephone calls made in connection with the ApalyRx program may be monitored or recorded for quality assurance, training, and compliance purposes.

Section 4: Rates and Charges

4.1 Carrier Rates. Apaly Health does not charge you for calls or text messages sent under this Consent. However, standard message and data rates imposed by your mobile carrier or telephone service provider apply to all text messages and calls you receive and send. You are solely responsible for any charges imposed by your carrier.

4.2 Data Usage. Receipt of multimedia messages and use of the ApalyRx mobile application may consume mobile data. You are responsible for any data charges imposed by your carrier.

Section 5: How to Opt Out

5.1 Opt Out of Text Messages. You may opt out of text messages at any time by replying STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any text message you receive under this Consent. After opting out, you will receive a one-time confirmation message. You will then stop receiving text messages, except as described in Section 5.3.

5.2 Opt Out of Calls. You may opt out of automated telephone calls by contacting Apaly Health at privacy@apalyrx.com or by calling the number provided in your account settings. You may also state your preference to opt out during any call with an Apaly Health representative.

5.3 Transactional Communications After Opt Out. Opting out of marketing and promotional communications does not stop transactional communications directly required to process your active prescriptions, such as cost share disclosure and payment confirmation requests. If you wish to stop all communications, including transactional messages, you must withdraw from the ApalyRx program entirely as described in the Patient Consent and Acknowledgment at apalyrx.com/legal.

5.4 Re-Enrollment. If you opt out and later wish to receive text messages again, you may re-enroll by texting START or UNSTOP to the number from which you previously received messages, or by updating your communication preferences through your account at apalyrx.net.

5.5 Partner Opt Outs. Opting out of Apaly Health communications does not automatically opt you out of communications from Dispensing Pharmacy partners or Program Suppliers who may have their own separate communication programs. To opt out of those communications, follow the opt-out instructions provided in their respective communications.

Section 6: Privacy and Security of Health Information

6.1 PHI in Text Messages. Communications sent under this Consent may include your Protected Health Information, including prescription details, cost share amounts, medication names, and other health-related information. Sending health information by SMS text message is not always secure. Third parties, including your mobile carrier, may be able to access your Protected Health Information transmitted via text message.

6.2 Decision to Use Text Messaging. Do not use text messaging to receive prescription communications if you are concerned about the privacy of your health information. You may contact Apaly Health at privacy@apalyrx.com to discuss alternative communication methods.

6.3 HIPAA Authorization. This Consent does not replace or modify your HIPAA Authorization. The use and disclosure of your Protected Health Information in connection with the ApalyRx program is governed by the HIPAA Authorization at apalyrx.com/legal. Communications sent under this Consent may reference your health information only to the extent authorized by your HIPAA Authorization and applicable law.

Section 7: Support and Help

7.1 Text HELP. For help with text message communications, reply HELP to any text message you receive. You will receive a response with support contact information.

Section 8: Changes to This Consent

Apaly Health may modify this Consent from time to time by updating the document at apalyrx.com/legal. If changes are made, Apaly Health will update the date at the top of this document. Your continued use of the ApalyRx program following any update constitutes your acceptance of the updated Consent. If you do not agree to the updated Consent, you must opt out of communications as described in Section 5 and withdraw from the program.

Section 9: Member Acknowledgments

By accepting the Apaly Health Inc. Terms of Use and this TCPA Communications Consent, you confirm the following:

• You have read and understand this Consent
• You are providing your express written consent to receive automated calls, prerecorded voice messages, and text messages from the parties identified in Section 1 in connection with the ApalyRx program
• You understand that this Consent is not a condition of receiving prescription services
• You understand that standard message and data rates apply
• You understand that text messages containing health information may not be fully secure
• You understand that you may opt out of marketing and promotional communications at any time by replying STOP to any text message
• You understand that opting out of transactional communications may affect your ability to complete prescription transactions through the program
• You understand that opting out of Apaly Health communications does not automatically opt you out of separate communications from Dispensing Pharmacy partners or Program Suppliers
• You represent that the telephone number or numbers you provided are valid numbers of which you are the owner or authorized user
• You agree to promptly notify Apaly Health if you stop using a particular telephone number
